Webmentix Group, its subsidiaries and branch operations hereinafter referred as ‘Webmentix’, ‘we’, ‘us’ or ‘our’ is committed to respect your privacy and choices. 

Acceptance of Terms and Conditions Webmentix Technologies Private Limited provides information on our website (the “Site”) subject to the following terms and conditions (the “Terms of Use”) and all applicable laws. The terms “we,” “our,” and “us” refer to Webmentix. The term “you” or “your” refers to each individual user of this Site and their use, as applicable. By accessing or using the Site, you acknowledge that you have read, understood, and agree, without limitation or qualification, to be bound by these Terms of Use and our Privacy Policy. If at any time you disagree with these Terms of Use and/or our Privacy Policy, your only remedy is to discontinue using the Site.

These terms and conditions set forth the legal framework for purchasing goods and services (“products”) from Webmentix Technologies Pvt. Ltd. “Products” refers to any and all goods, software, or services. Please review these terms carefully before making any purchase. 1. Who We Are

Webmentix Technologies Pvt. Ltd. is registered in India under registration number U62099UP2024PTC212084. Our registered office is located at 1886, Gaur City Center,  Sector 4,  Gautum Buddha Nagar, 201318,  Uttar Pradesh, India. Our GST Number is: 09AADCW9695B1Z5.

2. Our Products

The images of products on our Site or in other promotional materials are for illustrative purposes only. Although we strive to accurately display product colors, we cannot guarantee that your device’s display reflects the true color of the products. Variations may exist.

4. Orders & Delivery

4.1 Placing Orders

Orders must be placed in accordance with the procedures set by the company. Once accepted, orders are binding and cannot be canceled without written consent. You may place an order online, by email, or by post. In all cases, these terms will apply.

4.2 Pricing and Payment

All product prices are listed on our website and are subject to change. Delivery charges will be quoted separately. Payments should be made by cheque or demand draft in favor of Webmentix Technologies Pvt. Ltd. The prices quoted do not include taxes, which will be applied at the prevailing rate.

5. Warranties and Liability

5.1 Warranties

Products are subject to the manufacturer’s warranty terms. We facilitate warranty claims but are not responsible for compliance.

5.2 Limitation of Liability

Webmentix Technologies is not liable for any indirect, incidental, or consequential damages arising from the use of our products or services. Our liability is limited to the amount paid for the products in question.

6. Privacy and Security

6.1 Security

We use SSL encryption for all personal information submitted through the Site, ensuring that it is secure during transmission.

6.2 Use of Emails

We may communicate with you via email for quotes or other information. Our emails may contain confidential information, and if you are not the intended recipient, please notify us immediately and delete the email.

7. Software Licenses

By purchasing software products, you agree to comply with the relevant End User License Agreements (EULAs). These agreements, and any other terms from the software publisher, take precedence over any verbal or written information provided by Webmentix Technologies.

8. Product Information

All information regarding our products is provided in good faith, but we do not warrant that it is complete or up-to-date. It is your responsibility to verify product details, including pricing, directly with the manufacturer or supplier.

9. Exclusion of Liability

We exclude all express or implied warranties relating to the products and services we sell, except where required by law. This exclusion does not apply to claims related to death, personal injury, or fraud.

10. Limitation of Liability

Our liability for any loss or damage arising from our products or services is limited to the amount you paid for the relevant products. In no event will Webmentix Technologies be liable for any indirect or consequential damages.

11. Payment Methods

If you are making a payment through a bank transfer, you are responsible for any associated bank fees. If you are paying by debit or credit card, we will not process your payment until we dispatch your order. Payment for products and any applicable delivery charges must be made in advance, subject to clause 12.

12. Credit Terms for Account Holders

If you are a corporate customer and would like to set up an account, please contact us. For customers with a credit account, payment is due within thirty (30) days of the invoice date. We reserve the right to charge interest on late payments at a rate of 2% per month, accruing from the due date until full payment is made, regardless of whether judgment has been passed.

13. Proforma Invoices

Proforma invoices are valid for five (5) working days, or until the end of the current month if that occurs earlier. An official order referencing the proforma number is required before we ship the goods.

14. Eligibility for Purchase

To purchase software upgrades or renewals, you must provide the serial number of the current product(s). For academic product purchases, proof of academic status must be provided.

15. Returns Policy

We are not obligated to accept returns or cancellations for the following:

• Digital items where a software key or pre-licensed executable has been issued.
• Products that cannot be returned or canceled per the publisher’s or supplier’s policy.
  Do not return goods without an authorized Return Merchandise Authorization (RMA) number.
  To request an RMA number, contact us at +91-7827669934 or email [email protected] within 5 working days of receiving the product(s).
  Ensure goods are properly repacked. Products that are damaged upon return will not be credited and will be sent back to you at your expense.
  Returns of opened goods are generally not accepted. To prevent software piracy, we will only consider returns for opened goods at our discretion.

Damaged Goods:

Inspect your order upon receipt. If you find any defects or damage, contact us within five (5) working days. We will determine whether to replace the product or refund the purchase price, provided the damage is not due to misuse or damage during transit.

Exchanges and Refunds:

To request an exchange or refund, contact us within five (5) working days of receiving your order. If an RMA number is issued, return the product(s) at your expense in their original, unused condition. Once we receive the goods in their original condition, we will refund the amount paid, minus a 5% handling fee (plus VAT) or the cost of returning the goods to the manufacturer, whichever is greater.

16. Trademarks

"Webmentix®" is a registered trademark of Webmentix Technologies Pvt. Ltd. You must not use or display these trademarks without written permission from Webmentix or the relevant trademark owner. Other trademarks of software suppliers may also appear on our website or in other materials, which may be subject to copyright and trademark restrictions.

17. Intellectual Property

The content on this website, including text, images, and their arrangement, is the property of Webmentix or its licensors. Unauthorized use of this content may violate intellectual property laws. Nothing on this site grants any license or rights to use the intellectual property of Webmentix or any third parties.

18. Trading Hours and Response Times

Webmentix Technologies office operates from 10:00 AM to 6:00 PM Indian Standard Time, Monday to Friday. We are closed on weekends and public holidays. All orders and inquiries will receive an acknowledgment email, and customer emails will be responded to within one (1) working day, unless circumstances beyond our control (e.g., email failure) prevent us from doing so.

19. Jurisdiction and Penalties

All contracts are deemed to be entered into at Gautum Buddha Nagar, and in the event of any dispute, only the courts in Gautum Buddha Nagar or Noida,  shall have exclusive jurisdiction. Customers will not hold the company liable for any civil, criminal, or other losses incurred after delivery of the goods.

Please note that Webmentix is a marketing and distribution company, and any warranties on products are governed by the manufacturer’s terms and conditions.

Payments by cheque or demand draft must be made as per the agreed terms. A penalty of Rs. 500 will be applied for each cheque bounce, along with overdue interest and applicable legal penalties at a rate of 24% per annum from the date the bill becomes due.
